These Terms & Conditions ("Terms") govern your subscription to OnCall247 ("the Service"), an AI voice-agent service provided by Momentum Property Partners LLC ("we", "us"). By starting a trial or subscription you ("the Customer") agree to these Terms.
1. Free trial
New subscriptions begin with a 7-day free trial starting at checkout. A valid payment card is collected upfront via our payment processor (Stripe) to activate the trial, but you are charged $0 during the 7-day trial period. The trial clock starts the moment you complete checkout — there is no second trigger. The first charge lands 7 days after checkout unless you cancel before then.
Your plan's included minutes per month are available from the start of your trial — 300 minutes on the Starter plan, 1,000 minutes on the Pro plan. Minutes used during the trial count toward your first billing period. Usage beyond your plan's included minutes is billed at your plan's overage rate: $0.50 per minute on Starter, $0.25 per minute on Pro.
Promotional codes may extend the trial to a longer period (e.g. 14 days); the exact length is stated on the code. All other terms apply equally to extended trials.
2. Subscription pricing after the trial
Unless you cancel before the trial ends, your chosen plan bills automatically:
- Starter — $247 per month, billed monthly starting 7 days after checkout, or $2,470 per year billed annually starting 7 days after checkout (approximately two months free compared with monthly billing). Includes 300 minutes per month; $0.50 per minute after.
- Pro — $397 per month, billed monthly starting 7 days after checkout, or $3,970 per year billed annually starting 7 days after checkout (approximately two months free compared with monthly billing). Includes 1,000 minutes per month; $0.25 per minute after.
3. Cancel anytime
You may cancel anytime, self-serve, through the Stripe Billing Portal linked from your order-confirmation page, or by contacting us directly. Cancellation takes effect at the end of the current paid billing period; the Service remains active until then. Cancel during the 7-day trial and you are charged nothing ($0).
4. Refunds
Payments are non-refundable. We do not refund partial months on the monthly plan and we do not refund partial years on the yearly (annually billed) plan. When you cancel, you keep access for the remainder of the period you have already paid for, and no further charges are made.
5. The Service
The Service provides an AI voice agent that answers calls on your behalf. We aim for high availability but do not guarantee uninterrupted operation. You are responsible for how the agent is configured and for complying with applicable call-recording, disclosure, and telemarketing laws in your jurisdiction.
6. Acceptable use
You may not use the Service for unlawful, deceptive, or abusive purposes, including spam calling, fraud, or impersonation. We may suspend or terminate accounts that violate this section.
7. Payment processing
Payments are processed by Stripe. Card details are collected and stored by Stripe and never touch our servers. By subscribing you also agree to Stripe's terms for payment processing.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising from the Service is limited to the amounts you paid us in the three months preceding the claim. The Service is provided "as is" without warranties of any kind.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated before they take effect, and continued use of the Service constitutes acceptance.
